1. Introduction and Scope

Inbound Creative ("Company," "we," "us," or "our") is a digital marketing company providing lead generation, customer acquisition, marketing, and customer care services, including outbound and inbound phone calls and text messages, to businesses ("Clients") and to individuals who inquire about, engage with, or are referred to our Clients' products or services ("you," "Leads," or "Consumers").

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you: (a) visit our websites or landing pages; (b) submit an online form, call, or text us; (c) are contacted by us on behalf of a Client; or (d) otherwise interact with our marketing, sales, or customer care communications. It applies to Texas residents and, where applicable, to individuals located elsewhere who interact with our services.

If you are a California, Colorado, Connecticut, Virginia, or other state resident, you may have additional rights under your state's law; contact us using the information in Section 14 for details specific to your state.

2. Information We Collect

We collect the following categories of personal data, depending on how you interact with us:

  • Identifiers: name, mailing address, email address, phone number(s), and online identifiers such as IP address or device ID.
  • Commercial information: products or services you inquired about, purchase or inquiry history, and preferences you share with us.
  • Communications data: content and metadata of calls, texts, emails, and chat messages, including call recordings and text message logs, where permitted by law and disclosed to you.
  • Internet and network activity: pages visited, links clicked, referral source, and interaction with our ads, websites, and landing pages, collected through cookies and similar technologies (see Section 11).
  • Geolocation data: general location derived from your IP address or, if you provide it, your address or ZIP code.
  • Sensitive personal data: we do not intentionally collect Social Security numbers, government IDs, precise geolocation, health information, or similar sensitive categories through our marketing and lead-generation activities. If a Client's program requires such data (e.g., insurance or healthcare lead generation), we will identify the categories collected and obtain any consent required by law before collecting it.

We collect this information directly from you (forms, calls, texts, chat), automatically (cookies, pixels, analytics), from our Clients (when they provide contact information for follow-up marketing or customer care), and from third-party data providers and marketing partners who supply lead or co-registration data with appropriate consent.

3. How We Use Your Information

We use personal data to:

  • Respond to your inquiries and provide the products, services, or information you requested;
  • Market and advertise our Clients' products and services to you by phone, text message, email, mail, or online advertising, consistent with the consent you provide;
  • Provide customer care, account support, and follow-up communications on behalf of our Clients;
  • Score, route, and qualify leads for our Clients;
  • Operate, maintain, and improve our websites, landing pages, and marketing systems;
  • Analyze and measure the performance of marketing campaigns;
  • Detect, investigate, and prevent fraud, abuse, and security incidents;
  • Comply with legal obligations, including telemarketing, do-not-call, and data privacy laws; and
  • Enforce our agreements and protect our legal rights.

We do not use precise geolocation data or sensitive personal data to make decisions that produce legal or similarly significant effects concerning you.

4. Calling and Texting You: Consent, TCPA, and Texas Law

Because our business involves calling and texting leads and customers, we design our practices around the federal Telephone Consumer Protection Act (TCPA), the FCC's implementing rules, and Texas law, including Chapters 302, 304, and 305 of the Texas Business and Commerce Code.

4.1 Consent

We will only place marketing or promotional calls or texts to you using an automatic telephone dialing system, an artificial or prerecorded voice, or SMS/MMS technology if we have your prior express written consent, or another lawful basis recognized under the TCPA and Texas law (for example, an established business relationship or a request you initiated). Consent is not a condition of purchasing any goods or services.

4.2 Registration and No-Call Compliance

Under Texas Business & Commerce Code Chapter 302 (the Texas Telephone Solicitation Act), as amended by S.B. 140 (effective September 1, 2025), businesses that make telephone solicitation calls generally must register with the Texas Secretary of State and post the required security, unless an exemption applies. Inbound Creative [is registered with the Texas Secretary of State as a telephone solicitor, registration no. [REGISTRATION NUMBER] / relies on the following exemption(s): [DESCRIBE EXEMPTION, e.g., prior-consent text messaging under Tex. Bus. & Com. Code §304.002(10), established business relationship, or business-to-business communications] — confirm current status with counsel before publishing]. We do not call numbers on the Texas No-Call List or the National Do Not Call Registry unless we have your prior express written consent, an established business relationship, or another lawful exemption applies.

4.3 Calling Hours and Caller ID

We restrict telemarketing calls to the hours permitted by law (generally between 8:00 a.m. and 9:00 p.m. local time for the called party) and do not use inaccurate or spoofed caller ID information.

4.4 Call Recording and Monitoring

Some calls may be recorded or monitored for quality assurance, training, and compliance purposes. Where required by law, we will notify you that a call may be recorded before recording begins.

5. Text Message (SMS/MMS) Terms

If you opt in to receive text messages from us or on behalf of a Client:

  • Message and data rates may apply.
  • Message frequency varies based on your interactions and preferences.
  • You may opt out at any time by replying STOP to any message; you will receive a one-time confirmation that no further messages will be sent.
  • Reply HELP for assistance, or contact us using the information in Section 14.
  • Carriers are not liable for delayed or undelivered messages.
  • Text messaging originator opt-in data and consent will not be shared with third parties for marketing purposes unrelated to providing the requested services.

Consent to receive text messages is obtained separately from, and is not a condition of, any purchase.

6. How We Share Your Information

We may share personal data with:

  • Our Clients: the businesses whose products or services you inquired about, so they can follow up, market to you, or provide customer care, consistent with the consent you gave.
  • Service providers and processors: vendors that host our data, operate our dialing and texting platforms, provide analytics, or support customer care, under contracts that restrict their use of your data to providing services to us.
  • Marketing and advertising partners: platforms used to deliver, measure, or optimize advertising campaigns, which may involve sharing identifiers for targeted advertising unless you opt out (see Section 8).
  • Legal and safety purposes: when required by law, subpoena, or court order, or to protect the rights, property, or safety of Company, our Clients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

We do not sell sensitive personal data. To the extent any sharing of personal data for cross-context behavioral advertising constitutes a "sale" under the TDPSA, you may opt out as described in Section 8.

7. Data Retention

We retain personal data for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide services to our Clients, comply with legal, tax, and regulatory record-keeping requirements (including telemarketing consent and Do Not Call records), resolve disputes, and enforce our agreements. Retention periods vary by data type and Client program; call and text consent records are generally retained for as long as the applicable account is active, plus three (3) years, to demonstrate TCPA and Texas law compliance.

8. Your Privacy Rights Under Texas Law (TDPSA)

If the Texas Data Privacy and Security Act applies to our processing of your personal data, you have the right to:

  • Confirm whether we are processing your personal data and access it;
  • Correct inaccuracies in your personal data;
  • Delete personal data we have collected or obtained about you;
  • Obtain a portable copy of your personal data in a readily usable format;
  • Opt out of the processing of your personal data for (a) targeted advertising, (b) the sale of personal data, and (c) profiling in furtherance of decisions that produce legal or similarly significant effects; and
  • Appeal a decision we make regarding your privacy request.

8.1 How to Exercise Your Rights

You may submit a request by emailing help@inboundcreative.com. We will verify your identity using information reasonably necessary for verification, and you may designate an authorized agent to submit a request on your behalf. We will respond within 45 days of receipt, with one 45-day extension where reasonably necessary; if we decline to act on your request, we will explain why and provide instructions for appeal.

8.2 Appeals

If we deny your request, you may appeal by emailing help@inboundcreative.com. We will respond to your appeal within 60 days, as required by the TDPSA. If we deny your appeal, you may contact the Texas Attorney General's Consumer Protection Division at consumerprotection@oag.texas.gov or 1-800-621-0508.

8.3 Universal Opt-Out Signals

Where technically feasible, we honor opt-out preference signals, such as Global Privacy Control (GPC), sent through your browser as a valid request to opt out of targeted advertising and the sale of personal data on that browser or device.

8.4 Non-Discrimination

We will not deny goods or services, charge different prices, or provide a different level of quality because you exercised a privacy right under this Section.

9. Sensitive Data and Consent

We will not process sensitive personal data (such as precise geolocation, racial or ethnic origin, religious beliefs, health information, sexual orientation, citizenship/immigration status, genetic or biometric data, or data of a known child) without first obtaining your consent, except as permitted by law.

10. Children's Privacy

Our services are directed to adults, and we do not knowingly collect personal data from children under 13 (or process a known child's data for targeted advertising or sale without consent, consistent with the TDPSA and the federal Children's Online Privacy Protection Act). If we learn that we have collected personal data from a child without appropriate consent, we will delete it. Parents or guardians who believe we have collected a child's information may contact us using Section 14.

11. Cookies and Tracking Technologies

Our websites and landing pages use cookies, pixels, and similar technologies to operate the site, remember preferences, measure marketing performance, and deliver relevant advertising. You can control cookies through your browser settings and, where offered, through our cookie preference tool. Declining certain cookies may limit site functionality.

12. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal data from unauthorized access, use, disclosure, alteration, or destruction, appropriate to the volume and sensitivity of the data we process. No system is completely secure, and we cannot guarantee the absolute security of information transmitted to us.

13. Third-Party Links

Our communications and websites may contain links to third-party sites, including our Clients' websites. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post the revised policy with an updated "Last Updated" date and, where required by law, provide additional notice of material changes.
